Rentals & leasing waiver templates
Renting out gear — bikes, kayaks, tools, party equipment — puts your property in someone else's hands and your liability on their use of it. The rental agreement confirms the renter inspected the equipment and accepted it in working order, accepts responsibility for damage and safe operation, and releases you from injury claims arising from ordinary use. It's where return condition, late terms, and who carries the risk get spelled out before the gear leaves.

View template →Rentals & leasing waivers — common questions
- Does the renter or I bear the risk while equipment is out?
- Typically the renter accepts responsibility for the equipment and its safe use once it leaves your premises — the agreement records that they inspected it, accepted it in good condition, and took on that responsibility. Your own negligence (renting known-faulty gear) isn't waived away.
- Should the renter acknowledge the equipment's condition at pickup?
- Yes. A condition acknowledgement at pickup is your best defence against a later "it was already broken" dispute and clarifies who's responsible for damage found at return.
