Ihre eigene Fahrlässigkeit (die Vermietung von Geräten mit bekannten Mängeln) ist davon nicht ausgenommen.
Sollte der Mieter den Zustand der Ausrüstung bei der Abholung bestätigen?: Ja. Eine Zustandsbestätigung bei der Abholung ist Ihr bester Schutz gegen spätere Streitigkeiten über bereits vorhandene Schäden und klärt die Verantwortlichkeit für bei der Rückgabe festgestellte Mängel.
